Liability Waiver

CONSENT, RELEASE OF LIABILITY AND ASSUMPTION OF RISK  FOR PARTICIPATION IN BEND CURLING CLUB ACTIVITIES 

WHEREAS, Bend Ice, an Oregon Non-Profit Corporation, operates a curling program under the name “Bend Curling Club”; and 

WHEREAS, Bend Ice is, or intends to become, a local club of USA Curling, the national governing body of curling in the U.S., and 

WHEREAS, the above-identified Participant desires to participate in curling-related activities offered by the Bend Curling Club, including, without limitation, dry land training, practices, open houses, Learn to Curl sessions, meetings, parties, games, fundraisers, exhibitions, trials, tournaments, Bonspiels and all activities ancillary or incidental thereto (collectively, the “Bend Curling Club Activities”); and 

WHEREAS, I/we recognize that certain risks are inherent in Participant’s participation in sports activities in general, and the Bend Curling Club’s Activities in particular, including, without limitation, the risk of property damage, bodily injury or death to Participant; and 

WHEREAS, with full understanding and knowledge of the nature of the risks, it is my/our desire that Participant be permitted to participate in any and all Bend Curling Club Activities;

THEREFORE, in consideration for Participant being permitted to participate in Bend Curling Club Activities, I/we agree as follows:

1. I/we expressly consent to Participant participating in any of the Bend Curling Club Activities.
   
   
2. For myself/ourselves, Participant, and each of our respective heirs, agents, representatives, estates, creditors, servants, successors, administrators and assigns, I/we hereby release, remise, acquit, hold harmless and forever discharge Bend Ice, the Bend Curling Club Steering Committee, USA Curling, and all of their respective former, current and future directors, officers, employees, agents, officials, representatives, members, and volunteers (hereinafter, the “Released Parties”) from any and all claims, actions, causes of action, demands, rights, suits, debts, sums, bills, liens, covenants, contracts, promises, judgments, expenses, compensation rights, attorney fees, costs, expenses, damages or other liabilities of any nature whatsoever, whether based in common law, statute, contract or otherwise, that I/we or Participant now have or which may hereafter accrue in law or in equity, including, without limitation, all known and unknown, foreseen and unforeseen, developed and undeveloped damage and the consequences thereof, directly or indirectly resulting or stemming from, or in any way related to Participant’s participation in any of the Bend Curling Club Activities. 
   
   
3. I/we affirm that we understand the risks inherent in Participant’s participation in Bend Curling Club Activities, and that I/we hereby assume all such risks to the fullest extent allowed by law.
   
   
4. I/we acknowledge and agree that Participant’s participation in Bend Curling Club Activities is wholly voluntary on our part.
   
   
5. I/we expressly agree that this Agreement is intended to be as broad and inclusive as legally permitted in favor of Bend Ice, the Bend Curling Club Steering Committee and USA Curling, and that if any provision contained herein is held to be invalid, all other provisions shall continue in full force and effect.
   
   
6. I/we enter into this Agreement voluntarily, with full knowledge of the facts and legal implications of entering into such an agreement, and with intent to be bound.

This Agreement must be signed by Participant or , if Participant is a minor child, by any and all parents/legal guardians of Participant, in order for Participant to be eligible to participate in Bend Curling Club Activities.
